Terms & Conditions
These are the binding terms between you and NV Care Solutions Inc., the Nevada corporation that operates the Swoosh marketplace at swoosh.care. By using the Swoosh app, the Swoosh website, or any service offered under the Swoosh brand, you agree to every provision below. The identical text is presented inside the Swoosh app and must be accepted there before you can book or accept care.

How to serve a 60-day Notice of Intent to Sue
Before commencing arbitration or filing any court action against NV Care Solutions Inc., you must serve a written Notice of Intent describing (a) your identity and contact information, (b) the dispute, and (c) the relief you seek. The notice begins a mandatory 60-day good-faith negotiation window. Send it by US Postal Service certified mail to:
NV Care Solutions Inc., Attn: Legal Notice, Las Vegas, Nevada (registered agent address is on file with the Nevada Secretary of State).
Any arbitration or court filing made before that 60-day period expires may be dismissed or stayed at NV Care Solutions Inc.'s request.
Swoosh Platform Terms
Applies to: CLIENT, RESPONSIBLE_PARTY, CAREGIVER
- Swoosh is the consumer brand of NV Care Solutions Inc., a Nevada corporation, and operates an electronic marketplace that connects clients with independent caregivers and partner caregiving agencies.
- Swoosh is NOT your employer, staffing agency, payroll company, tax advisor, medical provider, or home-care agency. Swoosh provides only the technology platform: discovery, document checks, payments routing, EVV, messaging, records, and dispute support — and nothing more.
- Swoosh's role is intentionally limited. Care is delivered by the caregiver (or, where indicated, by their employing partner caregiving agency). Swoosh's intake screening covers identity, fingerprint clearance, and a one-time check of on-file credentials. Swoosh does NOT continuously monitor, supervise, medically clear, or guarantee any caregiver's behavior, skill, or fitness.
- When a job is fulfilled by a caregiver supplied by a partner caregiving agency, that agency is the responsible employer or contractor of the rep, and YOU agree to indemnify, defend, and hold harmless NV Care Solutions Inc. for the acts and omissions of those reps; in those engagements Swoosh is solely the electronic marketplace.
- Swoosh does NOT verify, audit, monitor, renew, or continuously check any user's insurance. Caregivers contractually promise to obtain and maintain the liability and bonding insurance their state and engagement require, but that is a covenant we rely on — not something we re-confirm before each visit. Each client has an independent duty to ask the caregiver for current insurance proof, confirm coverage with the issuer, and decide for themselves whether the coverage is adequate. Operating without the insurance the law requires is a material breach by the caregiver and grounds for removal once Swoosh becomes aware of it.
- Swoosh's own insurance, where it exists, covers only Swoosh's marketplace and vetting processes. It does NOT cover the care visit itself, the caregiver's actions, property damage, or any injury during a visit. Coverage for the visit must come from the caregiver's policy (or their agency's policy) and, secondarily, from your own homeowner's, renter's, or supplemental policy.
- You have an independent duty to verify any caregiver you engage — read their credentials, ask for current insurance proof and confirm it directly with the issuer, ask questions, request additional documentation, and report anything you believe is incorrect or fraudulent at swoosh.care/support so we can investigate.
- You agree that any dispute with NV Care Solutions Inc. will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Clark County, Nevada. You waive your right to trial by jury and your right to participate in any class action.
- Before commencing arbitration or any court action, you must serve NV Care Solutions Inc. with a written 60-day Notice of Intent at the address registered with the Nevada Secretary of State; the parties will negotiate in good faith during that 60-day window.
- These terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules. Exclusive venue for any non-arbitrable claim is Clark County, Nevada.
- Swoosh may suspend or remove any user for fraud, expired documents we have on file, unsafe conduct, off-platform side deals, policy violations, or failed payments. Note specifically that Swoosh does NOT track caregiver insurance currency — caregivers self-attest at intake and contractually agree to maintain coverage; Swoosh acts only when a complaint, audit, or report shows the covenant is being broken.

Family / Client Direct-Care Agreement
Applies to: CLIENT, RESPONSIBLE_PARTY
- You — the client or responsible party — directly choose, hire, schedule, supervise, and pay the caregiver. Caregivers are independent providers, not Swoosh employees. Swoosh is the marketplace, not the employer.
- Because the relationship is direct, YOU are responsible for any tax obligations triggered by the engagement, including 1099 reporting, household-employer payroll, workers’-comp where required, and unemployment insurance. Swoosh does not withhold, file, or remit taxes on your behalf.
- Caregivers contractually promise to carry their own liability and (where required) bonding insurance, regulated by the authorities of the state where the visit occurs. Swoosh does NOT independently verify, renew, or continuously check that coverage. The caregiver alone is responsible for keeping it current; YOU as the client are responsible for asking the caregiver to show you the policy and confirming with the issuer before each engagement.
- You acknowledge that Swoosh's insurance covers only Swoosh's marketplace and vetting processes. It does NOT cover the visit itself, property damage, theft, injury to anyone in the home, or the caregiver's acts or omissions. For losses during a visit you look first to the caregiver's insurance, then to your homeowner's / renter's or supplemental policy.
- You have a personal duty to perform reasonable due diligence on every caregiver you engage. Confirm credentials, ask for current insurance proof and verify it with the issuer, check references, ask questions, observe the first visit, and report anything inaccurate or suspicious to swoosh.care/support so we can correct or remove a profile.
- You cannot book a visit until you have accepted Platform Terms, this Direct-Care Agreement, the Household-Employer Notice, and any payment terms.
- Funds flow client → caregiver via Stripe Connect; Swoosh acts as a payment-routing agent only. Cancellation policy: free 30+ minutes before start; inside that window, the caregiver is paid a 1-hour minimum. Tips are charged separately and 100% go to your caregiver.
- No medical or skilled care unless the specific caregiver is separately licensed and approved on the platform. Refunds are issued only when Swoosh policies are followed by all parties.

Caregiver Independent-Provider Agreement
Applies to: CAREGIVER
- You are an independent provider, not an employee of NV Care Solutions Inc. or Swoosh. You are responsible for your own taxes (1099 self-employment), licensing, training currency, and conduct.
- You promise (this is a covenant on which Swoosh and every client relies) to obtain and continuously maintain the liability and, where required, bonding insurance regulated by the authorities of the state in which you provide care. Swoosh does NOT verify, renew, or continuously check this coverage; you alone are responsible for it. Operating on Swoosh without current required insurance is a MATERIAL BREACH of this agreement, grounds for immediate suspension, removal, and reporting to the relevant state authority once Swoosh becomes aware. By accepting work on Swoosh you re-affirm your insurance is current as of that moment.
- You cannot accept jobs until ID verification, fingerprint clearance card, profile, and this agreement are approved and current. Swoosh automatically blocks documents we hold (ID, fingerprint card, CPR) when they expire. Insurance is YOUR responsibility — Swoosh does not warehouse or check your policy on a recurring basis.
- EVV (electronic visit verification) proves visit time and location for payment and audit. EVV does NOT make Swoosh your supervisor — you remain in control of how care is delivered, within scope.
- Caregiver pay is shown separately from Swoosh's platform fee on every receipt. Caregivers receive 100% of any tip charged to the client.
- You must take notes for every visit; you cannot clock out without notes. Single shifts cap at 8 hours; the system closes the shift and pays out at the cap. Continuing care requires a new visit booked by the family.
- Off-platform side deals, contacting clients outside scheduled hours, or operating without insurance will end your account and may be reported to authorities and partner agencies.
- You agree that the dispute-resolution and choice-of-law provisions in the Platform Terms (binding individual arbitration in Clark County, Nevada under AAA Consumer Rules; 60-day Notice of Intent before action) apply with equal force to your independent-provider relationship with NV Care Solutions Inc.

Household-Employer Notice (US)
Applies to: CLIENT, RESPONSIBLE_PARTY
- When care becomes recurring or high-hour (for example weekly visits, 20+ hrs/week, or the same caregiver across many visits), federal and state law may classify YOU as a household employer.
- Household-employer responsibilities can include payroll taxes, workers’-comp coverage, and unemployment insurance. Swoosh does not provide payroll, W-2, or workers’-comp services.
- Use a household-payroll provider (e.g. Poppins, HomePay) or your accountant to remain compliant. Swoosh’s 1099-style independent-provider model may not satisfy household-employer obligations on its own.
- You acknowledge this notice and accept that you alone are responsible for following the applicable law in your state.
